If you are an F-1 student selected for a cap-subject H-1B petition, the time between Optional Practical Training (OPT) and H-1B status can be stressful. Small mistakes with work authorization, reporting, travel, or school records can create serious problems. This plain-language checklist explains the practical steps described in a recent American Immigration Lawyers Association update.
The main message is simple: keep your F-1 record valid, stay in close contact with your employer and your school’s Designated School Official (DSO), and be very careful before making travel plans while an H-1B petition is pending.
1. File the H-1B Petition While OPT Is Still Valid When Possible
Being selected in the H-1B lottery is important, but selection alone does not provide cap-gap protection. The H-1B petition itself must be filed.
When an employer files a cap-subject H-1B petition while you are still in valid F-1 status, you may qualify for a cap-gap extension. This can help cover the period between the end of OPT and the start of H-1B status.
According to the update, the petition must request a change of status while you remain in the United States. It must also request a start date in the new fiscal year, which runs from October 1 through September 30. A petition filed through consular processing does not meet this change-of-status requirement.
If the petition is filed while you are on OPT, your F-1 status and work authorization may continue until April 1 or until a decision is made on the H-1B petition, whichever comes first. If the petition is filed during the F-1 grace period instead, you may remain in valid F-1 status during that period, but you cannot keep working.
2. Track Unemployment Days Carefully
OPT has limits on how many days you may be unemployed. Going over the limit can cause you to lose F-1 status.
The update states that regular OPT allows up to 90 total days of unemployment. STEM OPT allows up to 150 total days of unemployment, including the combined total that applies during the relevant OPT period.
If your H-1B petition was filed while you were on OPT, unemployment days continue to count during the cap-gap period. Do not assume that cap-gap protection pauses this count. Keep clear records of your employment dates, job changes, and any time between positions.
3. Complete STEM OPT Evaluations on Time
If you are on STEM OPT, there are additional reporting duties. You must complete the required self-evaluations at the required times, and your employer must sign the annual evaluation.
The update explains that the signed evaluation must be given to your DSO no later than 10 days after the reporting deadline. STEM OPT participants need two annual evaluations: one 12 months after the approved STEM OPT start date and another at the end of the 24-month STEM OPT period.
Put these dates on your calendar well in advance. Ask your employer for the needed signature early, rather than waiting until the deadline is close.
4. Avoid International Travel While the Petition Is Pending
International travel can be especially risky during the change from F-1 to H-1B status. The update warns that leaving the United States while the H-1B petition is pending may be treated as abandoning the request to change status.
It may also end the cap-gap extension. The update further notes that abandonment will likely trigger a $100,000 fee for new H-1B petitions, which many employers may not be able or willing to pay. It notes that exceptions may exist only in extraordinarily rare circumstances.
Before booking any trip outside the United States, speak with qualified immigration counsel about your specific situation. A travel decision should not be made based only on general information.
5. Ask Your DSO About an Updated Form I-20
Eligible students receive the cap-gap extension automatically, and SEVIS should update as it receives information about the H-1B petition. Still, you may need an updated Form I-20 showing the extension.
An updated Form I-20 may be useful for employment, a driver’s license renewal, or other practical needs. If SEVIS does not update automatically, the DSO can request that the information be corrected.
Contact your DSO early if you need updated documentation. This can help you avoid delays when an employer, government office, or other organization asks for proof of your current status.
6. Report Changes to Your DSO Within 10 Days
Your school needs accurate information in your SEVIS record. The update says you must notify your DSO within 10 days of changes to your employment, residential address, legal name, or periods of unemployment.
Failure to provide these updates can put your SEVIS record at risk of termination. Students on STEM OPT also must confirm with their DSO every six months that their SEVIS record is accurate.
A good practice is to keep a simple checklist of updates you have reported, the date you reported them, and any confirmation from your school.
Practical Steps to Take Now
- Confirm whether the H-1B petition has been filed, not simply selected in the lottery.
- Check whether you are still on OPT or in the F-1 grace period.
- Count your unemployment days and save your employment records.
- If you have STEM OPT, review your evaluation deadlines and obtain employer signatures on time.
- Do not make international travel plans without getting advice about the pending H-1B case.
- Contact your DSO about your SEVIS record and whether you need an updated Form I-20.
- Report address, employment, name, and unemployment changes within 10 days.
FAQ
Does H-1B lottery selection automatically extend my work permission?
No. The update explains that cap-gap protection comes from filing the H-1B petition, not from lottery selection alone.
Can I work if the H-1B petition is filed during my F-1 grace period?
You may remain in valid F-1 status during that time, but the update states that you cannot continue working.
Do unemployment days still count during cap-gap?
Yes. If the H-1B petition was filed while you were on OPT, unemployment days continue to count during the cap-gap period.
Can I travel outside the United States while my H-1B petition is pending?
The update warns that travel may be treated as abandonment of the change-of-status request and may end the cap-gap extension. Speak with immigration counsel before traveling.
What should I do if my SEVIS record does not update?
Contact your DSO. The update states that the DSO can request correction if the record does not update automatically.
